AEL Model Legislation
Because the Alcohol Exclusion Law is found is so many different states' laws, there is no “one size fits all” repeal legislation.
However, in 2001, the National Association of Insurance Commissioners adopted a new model Uniform Accident and Sickness Policy Provision Law (UPPL) that can be used in modified form to repeal the Alcohol Exclusion Law in most states.
The original NAIC model UPPL reads in part:
- Intoxicants and Narcotics: The insurer shall not be liable for any loss sustained or contracted in consequence of the insured's being intoxicated or under the influence of any narcotic unless administered on the advice of a physician.
The 2001 NAIC model UPPL adds the following language:
- This provision may not be used with respect to a medical expense policy.
- For purposes of this provision, “medical expense policy” means an accident and sickness insurance policy that provides hospital, medical and surgical expense coverage.
